1. Agreement to Terms

Welcome to Bonfire Base Studio, a technology collective focused on creating tools, services, and solutions that matter. Our work ranges from developing Discord bots that automate workflows, to building custom software applications, crafting AI integrations, designing automation scripts for servers and operational systems, and providing technical consultancy for clients.

By accessing or using any Bonfire Base Studio product or service, including our bots, applications, scripts, or support services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must immediately discontinue use of all Bonfire Base Studio products and services.

2. Legal Entity & Representation

"Bonfire Base Studio" operates as an independent technical collective and Doing Business As (DBA) brand, rather than a registered corporate entity. All legal agreements, contracts, and financial transactions are executed by and under the personal legal authority of the principal founder, Bon Jury Pecaoco. This framework enables agile operations while maintaining enterprise-grade technical standards.

3. Intellectual Property Rights

All intellectual property created by Bonfire Base Studio, including but not limited to source code, scripts, designs, AI models, documentation, and operational logic, remains the exclusive property of Bonfire Base Studio. Users may not copy, reproduce, distribute, or create derivative works without explicit, prior written permission from the owner. This restriction applies equally to internal and external clients, as well as users of our bots and applications. Unauthorized use of our intellectual property may result in immediate termination of access and potential legal action.

4. User Representations & Acceptable Use

When using Bonfire Base Studio services, you agree to act responsibly and ethically. You strictly agree to:

• Comply with all applicable local, national, and international laws.
• Respect the rights of other users and avoid behavior that is disruptive, abusive, or malicious.
• Refrain from spamming, harassment, or attempting to reverse engineer Bonfire Base Studio infrastructure.
• Follow Discord's Terms of Service and community guidelines when utilizing our Discord integrations.

5. Appointment, Proposal, & Consultation Policy

By scheduling an appointment or submitting a project proposal, you agree to provide accurate information and honor the scheduled time. We use an automated pipeline (Ember Bot) to manage reminders, proposals, and meeting links. Please note:

• We reserve the right to reject proposals, reschedule, or cancel appointments due to technical issues, limited capacity, or unforeseen conflicts.
• Misuse of our systems, including booking multiple overlapping slots, spamming proposal submissions, or providing false contact information, is strictly prohibited.
• Frequent "no-shows" or cancellations with less than 24 hours notice may lead to restricted access to the booking system, proposal submission, and our services.

6. Scope of Services & Integrations

As of the current date, the operational scope of Ember Bot is restricted entirely to the official BONFIRE BASE Ecosystem. Any unauthorized deployment or duplication of Ember Bot logic outside of this ecosystem is a violation of these terms.

7. Payments and Invoicing

Bonfire Base Studio accepts payments via direct digital wallet transfers (such as GCash) and bank transfers (such as GoTyme Bank). We provide official invoices for all generated transactions. By making a payment, you agree to the following:

• Because Bonfire Base Studio currently operates as a sole proprietorship (DBA), all invoiced payments are routed directly to the personal financial accounts of the principal founder, Bon Jury Pecaoco.
• For security, email verification via OTP is required before proceeding with any transaction, including submitting a project proposal, booking an appointment, or submitting payment proof.
• Payment confirmations are not automated. You must manually submit your Transaction Reference Number and Sender Name via our secure Invoice tracking portal. We use this to verify the transaction actually processed, but we do not permanently store these merchant reference numbers after verification.
• Unless otherwise specified in a signed service agreement or explicit milestone contract, all payments for custom software, consultation, and digital services are non-refundable once work has commenced or deliverables have been provided.
• Submitting falsified transaction references or attempting to defraud the payment verification system will result in immediate suspension of services, invoice cancellation, and permanent revocation of software licenses.

8. User-Generated Content (Reviews)

Our platform allows users to authenticate via Google to leave public reviews and testimonials. By submitting a review, you grant Bonfire Base Studio a non-exclusive, royalty-free, perpetual license to display, reproduce, and distribute your review (including your name and provided avatar) publicly on our website and marketing materials.

You agree not to post content that is defamatory, abusive, profane, spam, or violates the privacy or intellectual property rights of others. We reserve the right to remove or moderate any review at our sole discretion without notice.

9. Disclaimer of Warranties

Our mission is to create technology that provides tangible benefits. While we strive to deliver reliable, secure, and practical solutions, all Bonfire Base Studio products are provided on an "AS-IS" and "AS-AVAILABLE" basis without any warranties of any kind, either express or implied. Users should understand that technology is inherently imperfect; we do not guarantee that our services will be uninterrupted, error-free, or completely secure from external threats.

10. Limitation of Liability

You acknowledge that you assume full responsibility for your interactions with Bonfire Base Studio products, including any consequences of misuse, unintended outcomes, or errors in functionality. To the maximum extent permitted by law, Bonfire Base Studio, its founder, team members, and affiliates shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages—including loss of data or profits—arising from your use of or inability to use any product or service.

11. Modifications and Terminations

Bonfire Base Studio reserves the right to modify, update, or discontinue features, services, or products at any time without prior notice. We may also revise these Terms of Service periodically to reflect technical improvements or legal requirements. Continued use of our products after such updates indicates your acceptance of the revised terms.

Furthermore, we reserve the right to terminate or suspend services immediately for any individual or organization that violates these terms or engages in conduct deemed harmful to the integrity, security, or reputation of our ecosystem.
