1. Agreement to Terms

Bonfire Base Studio is a technology collective specializing in custom software engineering, Discord bot development, AI integration services, server automation, and technical consultancy. By accessing or utilizing any product, platform, or service provided by Bonfire Base Studio, you acknowledge that you have read, understood, and unconditionally agree to be bound by these Terms of Service. If you do not agree with any provision herein, you must immediately discontinue all use of Bonfire Base Studio products and services.

2. Legal Entity & Representation

"Bonfire Base Studio" operates as an independent technical collective under a Doing Business As (DBA) designation. All contracts, legal agreements, and financial transactions executed under the Bonfire Base Studio name are entered into by and under the personal legal authority of the principal founder, Bon Jury Pecaoco. This structure enables agile project delivery while maintaining enterprise-grade technical and contractual standards.

3. Intellectual Property, Deliverables, & Confidentiality

All proprietary technology developed by Bonfire Base Studio — including but not limited to internal source code libraries, bot engine architectures, reusable automation frameworks, AI model configurations, operational documentation, and design systems — remains the exclusive intellectual property of Bonfire Base Studio. Reproduction, distribution, reverse engineering, or creation of derivative works from any proprietary Bonfire Base Studio asset without prior written authorization is strictly prohibited.

Client Deliverables. For commissioned projects (custom software, bots, applications, or design work), full intellectual property rights to the bespoke deliverables are transferred to the client upon complete and final settlement of all associated invoices. Bonfire Base Studio retains ownership of its underlying core libraries, reusable engine components, and internal tooling that may have been utilized in the development process.

Confidentiality & Credential Security. All client-provided credentials, API keys, database access tokens, Discord bot secrets, server configurations, and proprietary business materials are treated with strict confidentiality. Bonfire Base Studio will not reuse, disclose, or expose client credentials under any circumstances. All deployment keys and access credentials are securely encrypted during active development and permanently purged upon project handover.

Branding & Attribution.

• Unpaid & Pro-Bono Engagements: For any system, application, or bot developed without monetary compensation (including voluntary, open-source, or pro-bono engagements), Bonfire Base Studio retains the unconditional right to display visible branding, badges, or watermarks identifying Bonfire Base Studio as the developer.
• Paid Engagements: For paid commercial projects, visible public-facing branding is included only upon mutual written agreement. If the client requests white-label delivery, Bonfire Base Studio will remove all visible public branding upon request.
• Technical Attribution: Regardless of branding arrangements, Bonfire Base Studio retains the right to embed non-public technical attribution within the application codebase (such as author metadata in package manifests, source code comments, or publisher identifiers) for provenance verification and internal identification purposes only.

4. Acceptable Use

By utilizing Bonfire Base Studio services, you agree to conduct yourself in accordance with all applicable local, national, and international laws. You specifically agree to:

• Respect the rights of other users and refrain from disruptive, abusive, or malicious conduct.
• Not engage in spamming, harassment, or any attempt to reverse engineer, decompile, or compromise Bonfire Base Studio infrastructure.
• Comply with Discord's Terms of Service and Community Guidelines when utilizing any Bonfire Base Studio Discord integration.

5. Project Proposals, Appointments, & Delivery Acceptance

By scheduling a consultation or submitting a project proposal through our platform, you agree to provide accurate information and honor all scheduled commitments. Bonfire Base Studio utilizes an automated coordination pipeline (Ember Bot) to manage proposals, appointment reminders, and meeting logistics.

• Bonfire Base Studio reserves the right to decline proposals, reschedule, or cancel appointments due to capacity constraints, technical limitations, or scheduling conflicts.
• Abuse of the scheduling or proposal systems — including spam submissions, fabricated requests, or hostile language — is strictly prohibited and may result in permanent restriction from all Bonfire Base Studio services.
• Repeated failure to attend scheduled appointments without prior notice may result in restricted access to future booking and consultation services.
• 14-Day Acceptance Period. Upon milestone delivery or final handover of commissioned software, the client is afforded a 14-calendar-day inspection period to review functionality and submit adjustment requests under our Service Remedy provisions. Upon expiration of this period without documented critical defect reports, the deliverable is deemed formally accepted. Subsequent requests are addressed through standard maintenance or new project agreements.

6. Scope of Services

The operational scope of the Ember Bot system is confined exclusively to the official Bonfire Base Studio server environment and authorized ecosystem channels. Deployment, replication, or utilization of Ember Bot outside this authorized environment without explicit written permission constitutes a material breach of these terms.

7. Payments, Invoicing, & Refund Policy

Bonfire Base Studio issues formal invoices for all commissioned services. All client payments are received directly by the principal founder. Email verification via one-time passcode (OTP) is required prior to processing any financial transaction to ensure the identity and intent of the transacting party.

• Temporary Data Handling. Transaction reference numbers, sender details, and payment verification records submitted during the invoice settlement process are retained on our servers for a maximum period of 24 hours following successful verification, after which they are permanently and irrecoverably deleted. Bonfire Base Studio does not store credit card numbers, banking credentials, or any other automated payment instrument data.
• No Cash Refunds. All payments, milestone deposits, and retainer fees are non-refundable in cash once engineering, development, or consultancy work has commenced. In the event that a client is dissatisfied with delivered work or requires modifications, Bonfire Base Studio will address the matter through remedial engineering, scope adjustments, or equivalent additional service aligned with the original project specifications.
• Maintenance Subscriptions. Recurring maintenance plans provide scheduled system monitoring, routine security patching, and minor defect resolution as defined in the applicable plan tier. Clients may cancel active maintenance subscriptions at any time prior to the commencement of the next billing cycle without incurring cancellation fees. Requests that exceed the defined maintenance scope require a separate project engagement.

8. User-Generated Content

By authenticating via Google to submit a public review on the Bonfire Base Studio website, you grant Bonfire Base Studio a non-exclusive, worldwide, royalty-free license to display your submitted review text, associated name, and public profile avatar. You represent that your review is truthful and reflects your genuine experience. Bonfire Base Studio reserves the right to remove any review that violates community standards, contains defamatory or abusive language, or constitutes spam.

9. Disclaimer of Warranties & Service Dependencies

All Bonfire Base Studio services, applications, bots, and tools are provided on an "AS-IS" and "AS-AVAILABLE" basis. Bonfire Base Studio makes no warranties, express or implied, regarding the uninterrupted availability, error-free operation, or absolute security of its services. Bonfire Base Studio products integrate with third-party platforms and APIs — including but not limited to Discord, Cloudflare, Google, and Zoom — and Bonfire Base Studio bears no liability for service disruptions, rate limiting, or outages originating from these external providers.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Bonfire Base Studio and its principal founder shall not be held liable for any indirect, incidental, special, consequential, or punitive damages, nor for any loss of profits, revenue, data, or business opportunity, arising from or related to your use of, or inability to use, any Bonfire Base Studio service or product.

11. Governing Law & Modifications

These Terms of Service shall be governed by, and construed in accordance with, the laws of the Republic of the Philippines, without regard to conflict of law principles. Bonfire Base Studio reserves the right to amend or update these terms at any time. Material changes will be communicated through our official website or community channels. Continued use of Bonfire Base Studio services following any such update constitutes acceptance of the revised terms.
